Jennifer R. McGlone handles complex, multi-party commercial disputes covering all aspects of litigation strategy, from inception through to resolution via settlement or trial, and beyond. Jennifer regularly appears in state and federal trial courts, mediations and arbitrations. Her appellate experience in commercial matters includes arguing before the U.S. Court of Appeals, Ninth Circuit, and drafting numerous appellate briefs resulting in published opinions at the state and federal level. Jennifer has experience with international commercial transactions and litigating across international lines.

Jennifer has assisted individuals, corporations and government agencies with complex, multi-party commercial contract disputes and business torts, director and officer liability issues, antitrust, intellectual property, insurance issues, partnership disputes, enforcement and defense of arbitration provisions and awards, and bankruptcy matters, amongst others.

Before joining the firm, Jennifer worked for several years in the San Francisco office of Thelen LLP. In addition, after completing her studies at Stanford Law School, Jennifer was a graduate research fellow with the Stanford Center for Conflict Negotiation.

Notable Engagements


Following are examples of matters Jennifer has handled.

  • At the trial court level, represented the California Department of Insurance in litigation against several French companies and banks in matters arising out of the insolvency and rehabilitation of Executive Life Insurance Company. The litigation resulted in hundreds of millions of dollars in pre-trial settlement and a favorable jury verdict of $700 million.
  • Assisted in investigation and successful litigation against officers and directors of insolvent insurance company on behalf of California Department of Insurance.
  • Served as co-plaintiff to whistleblower in false claims act case; liaison to the Attorney General's office to assist in establishing criteria for when government should pursue false claims act claims. Successfully defended corporate clients in false claims actions and provided advice regarding whistleblower investigations.
  • Successfully extricated corporate clients and directors and officers from litigation at the initial pleading stages, in complex, multi-party contract dispute; handled successful appeal of dismissal.
  • Represented consumer advocacy groups at trial and appellate level in mounting challenge to proposed statutes and regulations. Advocacy work in response to proposed legislation. Amicus curiae work on behalf of the California Chamber of Commerce advancing business interests in the courts of appeal.
  • Significant pre-and post-trial work on antitrust cases for corporate client, including handling issue of how jury should be instructed on evolving antitrust doctrine.
  • Secured arbitration awards in favor of clients on contract claims and defending awards. Successful enforcement of – and defense against – arbitration provisions.
  • On more than one occasion, successfully positioned clients in declaratory relief actions on partnership agreements and renegotiated partnership commitments, avoiding or resolving litigation. Negotiated intellectual property and antitrust issues in the coure of renegotiating and reforming partnership contracts.
  • Advised clients on insurance litigation and insurance regulatory issues, as well as provided advice concerning corporations' obligations to self-insure or obtain workers' compensation insurance. Co-authored of Current Legal Issues Affecting the Rights of State Self-Insurance Guaranty Funds, IAIABC Journal (Spring 2007).
